The English High Court also established a fast track “streamlined” procedure for certain patent cases, which will in theory get a case to trial much faster. Under this procedure
* Evidence is submitted entirely in writing;
* Cross examination of witnesses is restricted or completely absent;
* Document disclosure is extremely limited or disposed of entirely;
* Trial lasts 1-2 days
Cases on the fast track are supposed to be completed in 6-7 months. However, it is difficult to persuade a judge to put a case on the “fast track” if there are more than 2-3 patents at issue or if there is a substantial validity challenge.
