A usually non-binding form of dispute resolution where a neutral third party seeks to help the parties reach a mutually satisfactory settlement. In many legal systems a judge will require parties in a case to submit to mandatory non-binding mediation before trial. Many arbitration organisations also offer paid professional mediation services. To be effective a mediation clause should deal with mediator appointment and selection, set firm time frames and establish confidentiality – arbitration/mediation organisations have the advantage of offering standard clauses and administration of mediation.
