Instead the license is available by clicking on a hyperlink which may be entitled “license terms” but equally might be the words, “terms of use,” “use restrictions,” “legal” or copyright “notice.” If no affirmative act of consent to the license terms is necessary before accessing the materials, the enforceability of browse-wrap licenses is debatable; they are generally regarded as at least less legally enforceable than clickwrap or click licenses or shrink wrap licenses.
