Trademarks are divided into classes of goods or services—thus trademark applicants must state what category of products, e.g., cosmetics, they wish the trademark to be granted for. Any subsequent application for the same mark in the same class would presumptively give rise to a risk of confusion and would normally be denied. Trademarks can be applied for in multiple classes, for example both goods and services. The two international classification systems for trademarks, under the:
- Nice Agreement for classification of marks, and
- Vienna Agreement for classification of figures,
are established and maintained by WIPO, the World Intellectual Property Organization.
